Terms of Use
1. Acceptance of these terms
By downloading, installing, or using the Gulp app or visiting the Gulp website (drinkgulp.app), you agree to be bound by these Terms of Use. If you do not agree, do not use Gulp.
These terms form a legally binding agreement between you and Tayler Berens ("Gulp," "we," "us," or "our"), the individual developer of the Gulp iOS app.
2. Description of the service
Gulp is an iOS app that helps you track daily water intake and build hydration habits. Features include:
- Daily hydration logging and goal tracking
- Personalized goal calculation based on weight, activity level, and other factors
- Local hydration reminders and checkpoint notifications
- Social Lock — optional app restriction via Apple's Screen Time framework when checkpoints are missed
- Apple Health integration (optional, write-only)
- Home screen and lock screen widgets
- Gulp Pro subscription with additional features
We may add, modify, or remove features at any time without notice.
3. Eligibility
You must be at least 13 years old to use Gulp. By using the app, you represent that you meet this age requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these terms on your behalf.
4. Subscriptions & payments
Gulp offers a Gulp Pro subscription that unlocks additional features. Subscriptions are offered on a monthly or annual basis and are managed through Apple's App Store.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- You can manage and cancel your subscription at any time in your iPhone Settings → Apple ID → Subscriptions.
- No refunds are provided for partial subscription periods except where required by applicable law.
- Free trial offers, if available, will be described clearly in the App Store listing. Unused portions of a free trial are forfeited upon purchase.
5. Acceptable use
You agree to use Gulp only for its intended personal wellness purpose and in compliance with all applicable laws. You agree not to:
- Reverse engineer, decompile, or disassemble the app
- Attempt to circumvent any subscription or feature restriction
- Use the app in any way that could harm, disable, or impair it
- Use the app for any commercial purpose without our written permission
- Exploit any bug or vulnerability rather than reporting it responsibly
6. Not medical advice
Gulp is a personal wellness tool, not a medical device or service. The hydration goals, reminders, and recommendations provided by the app are general in nature and are not a substitute for professional medical advice, diagnosis, or treatment.
Always consult a qualified healthcare provider before making significant changes to your fluid intake, especially if you have a medical condition, take medications, or have been advised by a doctor regarding fluid restriction or requirements.
7. Intellectual property
Gulp and all of its content — including the app design, graphics, text, code, and the Gulp name and logo — are owned by Tayler Berens and are protected by copyright, trademark, and other applicable laws.
These terms grant you a limited, non-exclusive, non-transferable, revocable license to use Gulp on your personal Apple devices solely for its intended purpose. No other rights are granted.
8. Disclaimer of warranties
Gulp is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the app will be uninterrupted, error-free, or free of bugs. We do not guarantee that hydration goals or recommendations will be accurate for your individual circumstances.
9. Limitation of liability
To the fullest extent permitted by law, Tayler Berens shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Gulp, even if advised of the possibility of such damages.
Our total liability to you for any claims arising from these terms or your use of the app shall not exceed the amount you paid for Gulp in the twelve months preceding the claim, or $10 USD if no amount was paid.
10. Apple requirements
Gulp is distributed through Apple's App Store. You acknowledge that:
- These terms are between you and Gulp only — not between you and Apple.
- Apple has no obligation to provide support or maintenance for Gulp.
- In the event of any third-party intellectual property claim against the app, Apple is not responsible for the investigation, defense, or resolution of such claims.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Your use of Gulp is also subject to Apple's App Store Terms of Service.
11. Governing law
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Texas, and you consent to personal jurisdiction in those courts.
12. Changes to these terms
We may update these Terms of Use from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will provide notice within the app. Your continued use of Gulp after changes take effect constitutes your acceptance of the updated terms.
